These laws govern the collection, processing, and sharing of personal data for users in the European Economic Area (EEA) and the United Kingdom (UK). Compliance with these regulations is essential to maintain the integrity of the services and ensure the privacy and rights of the users.

Responsibilities as a Clickaine Publisher

As a Publisher using Clickaine services, you are responsible for ensuring that appropriate disclosures are made to users in the EEA and UK and that required consents are obtained. Non-compliance with this policy may result in limitations, suspension, or termination of your access to Clickaine services.

Requirements for Properties Under Your Control

If you use Clickaine services on any website, app, or other property controlled by you, your affiliates, or your clients, you must adhere to the following obligations for users in the EEA and UK:

  1. Obtaining User Consent
    • Secure legally valid consent from users for:
    • The use of cookies or other local storage, where required by law.
    • The collection, sharing, and processing of personal data where the consent is required by law, especially to personalize ads.
  2. Consent Management
    • Retain records documenting user consent.
    • Offer users clear instructions on how to withdraw their consent at any time.
  3. Data Sharing Transparency
    • Clearly identify any third party that may collect, receive, or use users’ personal data through your use of Clickaine services.
    • Provide users with accessible information on how each third party uses their personal data.

Requirements for Properties Under a Third Party’s Control

If you collect or share personal data from end users on a third-party property that you do not control, you must use reasonable efforts to ensure that the operator of that third-party property complies with these consent and disclosure requirements. A third-party property refers to any site, app, or platform outside the direct control of you, your affiliates, or your clients.

Additionally, if you share personal data with a third party that processes such data on your behalf, you are responsible for ensuring that an appropriate Data Processing Agreement (DPA) is in place between you and the third party, as required by General Data Protection Regulation (GDPR) and corresponding national legislation within the European Union. Clickaine is not a party to such agreements and assumes no responsibility for ensuring compliance with data protection obligations between you and any third party.
